What happens if Josh Duggar pleads guilty? Critics of the Duggar family weigh
Fans and critics of the Duggar family are eager to hear what lies ahead for Josh Duggar. In April 2021, police arrested Josh on suspicion of downloading and obtaining child pornography. And it was recently reported that his team chose to delay his trial for several months after the original July 6 date. So far Josh has pleaded not guilty – but what if he pleads guilty in the end?
Where is Josh Duggar now? Police recently arrested him on suspicion of obtaining child pornography
Josh Duggar continues to cause trouble for the Duggar family. In April 2021, police arrested him on suspicion of having contained child sexual abuse. He allegedly downloaded content from one of his computers at his workplace. In 2019, Homeland Security raided his parking lot and it appears this situation led to Josh’s arrest in 2021.
In May 2021, Josh “was released by Judge Christy Comstock of the US District Court for the Western District of Arkansas” while awaiting trial. However, that does not mean that he could live freely. Josh is currently staying with family friends away from his wife, Anna Duggar, and he is unable to visit any minors. He can see his six children in Anna’s presence, but if not, he cannot visit them either. Not only that, but he is “home restricted at all times” and can only visit places outside the home with the permission of his probation officer.
What happens if Josh Duggar pleads guilty? Here’s what critics say about the Duggar family
Josh pleads not guilty to his alleged crimes. But what if he and his legal team decide to plead guilty and not be tried? Critics of the Duggar family on Reddit suspect the court should grant them a plea deal for this to happen.
“Without a deal, it’s almost rare,” noted one Reddit user. “He’ll just say he’s sorry and throw himself at the mercy of the court, hoping for a generous sentence when the judge decides, within his limited discretion, how many years to give him based on the charges.”
The same Reddit user noted that Josh was much more likely to agree to a plea deal. “… [I]In general, he will negotiate with the prosecution to reduce the charges against him and therefore risk fewer years in prison, âthey said. âEven ‘low level’ child pornography cases carry heavy prison sentences, so it may be in their best interests to just fight the charges, but a creative prosecutor can attempt to negotiate that. “
The Reddit user indicated that he believes Josh will wait until he sees the evidence the court has racked up against him before making a decision.
Josh Duggar will have to testify under oath if he pleads guilty
According to Nolo, Josh will also have to testify under oath if he chooses to plead guilty before or during the trial. By testifying, Josh will have to establish his guilt. The judge must make sure Josh understands the rights he is waiving by pleading guilty. The accused (in this case Josh) must admit the illegal conduct, admit the charges against him, know the rights he waives by pleading guilty, and know the consequences of the plea.
However, things can get trickier if advocacy is not âknowledgeable and smartâ. If Josh is arguing without a lawyer, for example, Josh could request that the conviction be removed from his case altogether.
Looks like Josh has a strong legal team behind him, so we don’t expect the latter to happen. If anything, Josh can agree to a plea deal before his trial. Fans and critics of the Duggar family will find out.
